Definitions
1.1. Studio Collectables is an online store specializing in new and vintage home accessories and furniture, which can be visited via www.studiocollectables.shop and is located at Hazenweg 4, 1121 EW, Landsmeer, Netherlands.
1.2. In these general terms and conditions, Studio Collectables refers to the Partnership (V.O.F.), registered in the trade register of the Amsterdam Chamber of Commerce, with KVK number 85186325.
1.3. The term “customer” refers to any visitor of the webshop, whether a natural or legal person, who places an order via www.studiocollectables.shop.

Applicability
2.1. These general terms and conditions apply to any offer from Studio Collectables, any purchase by the customer, and any agreement between Studio Collectables and the customer to which Studio Collectables has declared these terms applicable.
2.2. When ordering via the webshop, the customer is asked to accept the general terms and conditions so that it can be established that the customer has been able to take note of them before completing the order. By placing an order, the customer declares to unconditionally agree to the terms of Studio Collectables. Deviations from these terms can only be made with written approval from Studio Collectables, in which case the other provisions remain in force.
2.3. Studio Collectables reserves the right to amend or supplement these General Terms and Conditions from time to time.
2.4. The website clearly indicates what the customer owes at the time of purchase and what their rights and obligations are.
2.5. Dutch law exclusively applies to all agreements between Studio Collectables and the customer.

Agreement
3.1. An agreement is concluded at the moment the customer places an order and receives an order confirmation from Studio Collectables via email at the email address provided by the customer. The customer and Studio Collectables have a valid agreement as soon as the order is confirmed by email. As far as the law allows, this electronic confirmation is considered as evidence.

The Offer from Studio Collectables
4.1. Studio Collectables sells mostly used items (vintage), and signs of use cannot be excluded. This is part of a vintage product. The customer therefore buys the product ‘as is’. Without requesting further information, the customer agrees to the condition in which the item is found. It is assumed that the customer is aware of the possibly outdated safety and usage requirements and regulations that were applicable at the time the product was manufactured or produced.
4.2. The rings offered by Studio Collectables are vintage and therefore previously worn. For this reason, they are considered unique and special by Studio Collectables. The rings have been inspected by a jeweler who checks them for material, stones, composition, and defects. Each ring is only available in the listed size. Rings cannot be resized by Studio Collectables. Studio Collectables advises the customer to consult a jeweler nearby for resizing.
4.3. Information, photos, and descriptions or statements provided by Studio Collectables regarding the offer, whether verbally, by phone, or via email, are given or made as accurately as possible. However, it is not guaranteed that all offered items fully correspond to the given or provided information about these items.
4.4. Studio Collectables also sells new items. The information provided about the item is given as accurately as possible, but it is again not guaranteed that all offered items fully correspond to the given or provided information about these items. For instance, new ceramic products may show slight differences from the example shown on the site due to handmade quality.
4.5. Studio Collectables cannot guarantee that the colors displayed on the provided information correspond exactly to the actual colors of the products.
4.6. Deviations of any kind cannot, in principle, be a reason for compensation and/or dissolution of the agreement. If the product deviates clearly from the data on the website, Studio Collectables will take appropriate measures to accommodate the customer.
4.7. Studio Collectables often sells lighting with the original wiring, which may no longer meet current regulations/standards. Studio Collectables recommends consulting an electrician before use. All our lighting fixtures are sold without light sources (light bulbs, halogen lamps, energy-saving lamps, and/or LED lamps). Any included light sources are used and come with no warranty.
4.8. Increases in the cost prices of products or components thereof that Studio Collectables could not foresee at the time of the offer or conclusion of the agreement may lead to price increases. The same applies to any increases in shipping or delivery costs.
4.9. Studio Collectables is not bound by its offer if the customer, within a reasonable period in societal views, should have understood that the offer contains an obvious mistake or typo.
The offer is non-binding. Studio Collectables is therefore entitled to amend and adjust the offer.
4.10. Products are available while supplies last.
4.11. Studio Collectables does not provide a warranty on used products; they are second-hand and sold ‘as is’. If something is clearly wrong within a reasonable time, the customer can report this via email. Depending on the situation, Studio Collectables may then take appropriate measures to accommodate the customer.

Reserving Products
5.1. It is possible to reserve products via the webshop. The reservation must be requested by the customer via email.
5.2. Given the unique nature of the products, Studio Collectables can reserve the products for the customer for a maximum period of 3 days unless otherwise agreed.
5.3. After the three-day period, Studio Collectables reserves the right to terminate the reservation and re-list the item in its offer.

Prices and Payments
6.1. All prices listed by Studio Collectables are expressed in euros. All prices include VAT and exclude shipping costs.
6.2. All offered used (vintage) items are margin items (i.e., not VAT items) and fall under the margin scheme. No VAT is mentioned on the invoice for margin items. VAT is therefore not deductible. Upon request, Studio Collectables can inform the customer whether an item is a margin or VAT item.
6.3. New items offered fall outside this margin scheme.
6.4. Orders via the website can be paid with:
- iDEAL
- Credit card
Once the order has been placed and the total amount has been credited to Studio Collectables’ account, the customer will receive an email confirming that the payment has been accepted and detailing the order.
6.5. Studio Collectables expressly reserves the right to change prices, particularly when necessary due to (legal) regulations.
6.6. Special offers are only valid for the duration mentioned on the website regarding that special offer or item.

Delivery of Orders
7.1. The customer pays shipping costs for each order. When the shipping rates are known, they are directly visible during the online ordering process at the payment stage. If the customer agrees to these costs, the payment can be completed. The website provides further information about payment options.
7.2. Once the payment for the item has been made and the money has been credited to Studio Collectables’ account, the delivery process will be initiated by Studio Collectables.
7.3. The shipping costs depend on the size, volume, and weight of the order. Smaller items are shipped by Studio Collectables via PostNL, using PostNL's rates.
7.4. Items sent by Studio Collectables are carefully packaged and delivered to a PostNL point within 3 working days. The customer will receive the associated tracking code by email in advance so that the package can be tracked.
7.5. Deliveries via PostNL are subject to the delivery times and conditions set by PostNL.
7.6. Only if items are too large or fragile to be shipped via PostNL can they be picked up by the customer. This can only be done by appointment with Studio Collectables.
7.7. If pickup is not possible, upon customer request, the purchased item can be delivered by Studio Collectables within the Netherlands and for a separately agreed fee. This may be done by Studio Collectables or by one of the professional transport companies it collaborates with. Particularly large and fragile items are preferred for personal transport. Costs depend on the type and size of the item and the distance to be covered.
7.8. To keep delivery costs as low as possible, we often combine multiple deliveries into one trip. The average delivery time for personal delivery is between 1 and 4 weeks and is always arranged in consultation. Studio Collectables delivers the product to the front door on the ground floor.
7.9. The place of delivery is the address provided by the customer to Studio Collectables. If Studio Collectables incurs additional costs due to an incorrect address, these costs are borne by the customer.
7.10. Although Studio Collectables carefully packs the products, damage during transport can never be completely excluded. For shipments via PostNL, the risk of damage and/or loss of products rests with the customer unless expressly agreed otherwise. The customer can choose registered shipping via the website. In case of visible damage to the packaging upon receipt, Studio Collectables advises reporting this immediately to the delivery person.
7.11. If the product is delivered by Studio Collectables, the risk of damage and/or loss of products rests with Studio Collectables until the moment of delivery.

Retention of Title
8.1. Ownership of the products passes at the moment the products are offered at the delivery address provided by the customer. If the customer fails to accept the products, any resulting damage and costs are at the customer’s expense. Any returns to Studio Collectables are at the customer’s expense.

Returning Products
9.1. If the customer wishes to return a received item, this must take place within 8 days of receiving/purchasing the item. The customer must notify Studio Collectables by email immediately after receiving the item. This is to receive any return instructions from Studio Collectables before returning the item.
9.2. Returns can only be made if the packaging and product are in the same condition as when Studio Collectables sent them to the customer. The return shipment must be accompanied by a fully completed return form included with the package.
9.3. All costs associated with returning the item are the customer’s responsibility and, if applicable, will be deducted from the amount to be refunded to the customer.
9.4. If the return process is carried out correctly and after Studio Collectables has received the returned item, the purchase amount (less any costs to be deducted) will be refunded to the customer within a maximum of 14 days.
9.5. If there is suspicion that the product(s) have been used or damaged by the customer or third parties, Studio Collectables reserves the right to refuse returned items or to only partially refund the amount.
9.6. If the item is in exactly the same condition as at the time of sale, it is also possible to return the products in person to Studio Collectables. This can only be done by appointment and in consultation with Studio Collectables.

Intellectual Property
10.1. The customer expressly acknowledges that all intellectual property rights of displayed information, images/photos, statements, or other expressions regarding the products and/or the website or its promotion are owned by Studio Collectables or other rights holders. Photos and images from Studio Collectables may not be used without permission.

Force Majeure
11.1. If one or both parties are hindered by circumstances not attributable to fault, force majeure, neither party is obliged to fulfill any obligation.
11.2. During the period of force majeure, parties may suspend their obligations under the agreement. If this period lasts longer than 2 months, either party is entitled to dissolve the agreement without being obliged to compensate the other party for damages.

Liability
12.1. The customer is presumed to be familiar with the – possibly outdated – safety and usage requirements and regulations applicable at the time the vintage products were manufactured.
12.2. The customer is always responsible for ensuring the safe and responsible use of products purchased from Studio Collectables.
12.3. Studio Collectables can only be held liable for damage attributable to its intent or fault, or caused by circumstances within its risks.
12.4. Studio Collectables is not liable for damage caused by third parties or for consequential damage due to improper use or defects not foreseeable by Studio Collectables.
12.5. Studio Collectables is never liable for indirect damage, including consequential damage, lost profits, missed savings, and damage due to business or other types of interruption.
12.6. Studio Collectables is not liable for any damage caused by relying on incorrect and/or incomplete information provided by or on behalf of the customer.
12.7. If Studio Collectables is liable for any damage, its liability is limited to a maximum of the invoice value of the agreement, or at least to the part of the agreement to which the liability relates.
12.8. Studio Collectables is never liable for indirect damage, including consequential damage, lost profits, missed savings, and damage due to business or other types of interruption.
13. Complaints Procedure
13.1. For complaints, the customer can send an email. Studio Collectables will always process the complaint. The complaint will be used as an opportunity to improve Studio Collectables’ services.
13.2. Studio Collectables will respond to submitted complaints within a period of 5 working days from the date of receipt. For complaints requiring a longer processing time, Studio Collectables will provide an acknowledgment of receipt and an indication of when the customer can expect a more detailed response within the same 5 working days.
